Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Ultra Resources, Inc. (CMP000768) to modify and operate the Boulder 4-33 PAD (F022940) with the addition of production and equipment associated with four new wells, the Boulder 6C1-28D, 6C2-28D, 10C2-28D and 14A1-28D, with three reboiler overheads condensers and three smokeless combustion devices to control volatile organic compound and hazardous air pollutant emissions associated with the dehydration units, located in the NW1/4NW1/4 of Section 33, T31N, R108W, approximately nine (9) miles south of Boulder, in Sublette County, Wyoming.  A Chapter 6, Section 2(c)(ii) demonstration in accordance with the Division’s Interim Policy has been conducted.  Emission offset requirements, if applicable, have been applied to this permitting action at a ratio of 1.5:1.0 for VOCs and 1.1:1.0 for NOx.  Permitting actions to date have resulted in a decrease in actual VOC emissions of 872.4 tpy and a decrease in actual NOx emissions of 687.2 tpy.  Therefore, Ultra Resources, Inc. has met the offset requirements for VOCs and NOx.

For the duration of the public comment period, the permit application, the agency’s analysis, and the public notice are available for public inspection online at https://openair.wyo.gov, utilizing facility ID F022940 and permit number P0037351 under permits.  This material may also be viewed online, at the above URL, utilizing a public computer at the Sublette County Library, Pinedale, Wyoming.  Additionally, for the duration of the public comment period a copy of this public notice is available for public inspection at the Sublette County Clerk’s Office, Pinedale, Wyoming.

The Town Council of the Town of Pinedale met in regular session on Monday, February 12, 2024, in the main conference room of the Pinedale Town Hall.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present:  Tyler Swafford, Dean Loftus, Judi Boyce and Scott Kosiba.  Those in attendance included: Matt Bowers, representing Nelson Engineering, Jessup Wyman, representing Main Street Pinedale; Peg Weber; Max Lockett; Ed Wood, Town Attorney; and Abram Pearce, Director of Public Works. Attending online were Jason Moyes, representing Moyes Family Homes; Cali O’Hare, representing the Pinedale Roundup; Maureen Rudnick; and Tesa Manning.

Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Swafford to amend the agenda to add G-6, Resolution 2024-05, a Resolution approving the placement of a lodging tax question on the next general election ballot.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve the January 22, 2024, regular Town Council meeting minutes as published.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Peg Weber encouraged Mayor Murdock and Town Council to proceed with possible office space rentals in Town Hall.

Councilman Swafford reported on Winter Carnival and expressed his gratitude to Town Staff for their assistance in preparing for a successful event.

Motion by Councilman Swafford to approve the consent agenda items as published.  Seconded by Councilman Loftus.  Motion passed 5-0.  Consent agenda items approved were the Sage & Snow Garden Club annual Memorandum of Understanding for 2024, for watering the flower barrels on Pine Street, in the amount of $5,386.50, and allowing pre-approved Sage & Snow volunteers to use the Town’s water truck; park and temporary use permit applications allowing PFAC to use American Legion Park and close North Madison Avenue during the Summer Soundcheck concerts on June 29, July 4, July 20, August 2, and August 16, 2024, and waive the fees; the purchase of twenty-five (25) water meter pits and appropriate insulation discs from Dana Kepner, in an amount not to exceed $42,000; aid in waterline repair costs at 333 Quartz Avenue payable to JB's Welding & Excavation, in the amount of $2,000.

Motion by Councilwoman Boyce to approve a request to the State Land and Investment Board to reduce the interest rates on the CW173 and DW220 loans for the Town of Pinedale, keeping the same annual payment amount, effectively reducing the term of the loans.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Motion by Councilman Kosiba to approve an extension of the final plat filing per the Subdivider request, pursuant to §400-33 B for Block 6 Subdivision, Bloomfield Addition, to the Town of Pinedale, Wyoming, for one (1) year requiring filing of the final plat by February 27, 2025.  Seconded by Councilwoman Boyce.  Motion passed 5-0.

Motion by Councilman Swafford to approve Amendment No. 1 to the Professional Services Agreement between the Town of Pinedale and Nelson Engineering in the amount of $15,000 for an amended scope to include sewer design for Jade Street and Shanley Avenue, for a total amended contract amount of $109,000.  Seconded by Councilman Kosiba.  Motion passed 5-0.

Abram Pearce and Matt Bowers presented funding options for the reconstruction of the damaged sewer collection system on Jade Street and Shanley Avenue. 

Applications to the Mineral Royalty Grant Program for the Pinedale Wastewater Treatment Facility Rehabilitation Phase 1 Project and the Redstone 2nd Addition Street Rehabilitation Project were also discussed by the Town Council.

Motion by Councilman Kosiba to approve Resolution 2024-02, a Resolution setting rates and fees for use of the airport, Ralph Wenz Field, for the Town of Pinedale.  Seconded by Councilwoman Boyce.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve Resolution 2024-03, a Resolution authorizing the submission of a Federal Mineral Royalty Capital Construction Account Grant application to the State Loan and Investment Board on behalf of the governing body for the Town of Pinedale for the purpose of the Pinedale Wastewater Treatment Facility Rehabilitation Phase 1 Project, in the amount of $707,175 with a local match of $707,175.  Seconded by Councilman Swafford.  Motion passed 5-0.

Town Council discussed Resolution 2024-04, a Resolution authoring the submission of a Federal Mineral Royalty Capital Construction Account Grant application to the State Loan and Investment Board on behalf of the governing body for the Town of Pinedale for the purpose of the Redstone 2nd Addition Rehabilitation Project, in the amount of $410,000 with a local match of $410,000; no action was taken.

Motion by Councilman Swafford to approve Ordinance 707, on first read, an Ordinance of the Town of Pinedale, State of Wyoming, amending Article XIII of Chapter 400 of the Pinedale Municipal Code titled Annexation in its entirety.  Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve Ordinance 708, on first read, an Ordinance of the Town of Pinedale, State of Wyoming, amending Article XIV of Chapter 400 of the Pinedale Municipal Code titled Water Rights in its entirety.  Seconded by Councilman Kosiba.  Motion passed 5-0.
