The Town of Marbleton is seeking sealed bids for the sale and removal of surplus equipment & property.  All bids must be received by 12 p.m. on May 10, 2024 in the Clerk’s Office, 10700 Hwy 189, Marbleton, WY 83113.  Bids received after this date and time will be returned unopened to the bidder.  Bid opening will be held at 2pm at the Marbleton Town Hall on Friday, May 10, 2024.  Bids will be awarded at the Town Council meeting at 5pm on Monday, May 13, 2024. 

Please contact the Town Hall to obtain a bid sheet to be used for this sale.  Bid sheets can also be emailed when requested.

Each submitted bid should be in a sealed envelope marked, Town of Marbleton, Sale of Surplus Property.  If mailed, the bid submission should be in a similarly marked separate sealed envelope to protect against the bid being opened in error. 

Items offered for sale, unless otherwise noted, may be viewed during business hours or upon request at the Marbleton Maintenance Shop at 601 Taylor Avenue in Marbleton.

**The Town reserves the right to reject any and all bids if deemed to be in the best interest of the Town.

**All bids will be evaluated separately.  Collective bids will be rejected.

**All surplus property will be sold “as-is”.  The Town of Marbleton makes no express or implied warranties on the items.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, the Commission hereby gives notice of the Application of Rocky Mountain Power (RMP or the Company) for authority to cancel tariff Schedule 197, 2017 Federal Tax Act Adjustment, as more fully described below.

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.

2. On April 8, 2024, RMP filed its Application, requesting authority to cancel tariff Schedule 197, and remove credits related to the 2017 Tax Cuts and Jobs Act (TCJA) to customers due to the excess deferred income tax being fully amortized, effective July 1, 2024.

3. RMP recorded the difference between the federal income tax liability in effect on December 31, 2017, and January 1, 2018, per Commission Order in Docket Nos. 20000-510-EA-17, 90000-134-XO-17, 20000-536-ER-18, 20000-560-EA-19, and 20000-578-ER-20. This was done with the intention of returning the benefit to customers under Commission specified terms, which included returning TCJA benefits over a period of 3 years. RMP states it has returned the TCJA benefits to customers, and as of July 1, 2024, the Company expects the remaining tax balance to be fully amortized, rendering Schedule 197 unnecessary.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules, the Commission hereby gives notice of the Application of Rocky Mountain Power (RMP or the Company) for authority to Establish Final Low-Carbon Energy Portfolio Standards pursuant to the provisions of Wyoming Statute § 37-18-102 and Chapter 3, Section 38 of the Commission’s rules, as more fully described below.

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission's jurisdiction. Wyo. Stat. §§ 37-l-101(a)(vi)(C) and 37-2-112.

2. On March 29, 2024, RMP filed this Application, requesting authority to establish Final Low-Carbon Portfolio Standards pursuant to Wyoming Statute § 37-18-102, Commission Rule Chapter 3, Section 38, and Docket No. 20000-616-EA-22 (Record No. 17032). It addresses Dave Johnston Unit 4 and Jim Bridger Units 3 and 4. These units are utility owned, coal-fired generation facilities.

3. RMP states it has completed the submission and evaluation phases of the Carbon Capture, Utilization and Storage (CCUS) Request for Proposals (RFP). The RFP was issued in November 2022, and later supplemented with a Request for Information (RFI) in February 2023. The Company received one proposal in the RFP, and seven information packages as a result of the RFI. RMP proposes in this Application that the Commission approve a feasibility study (with expectation of progressing into a pre-front-end engineering and design (FEED) or pre-FEED study) for a solids fuel-fired Allam Fetvedt Cycle (AFC) project located at either the Dave Johnston or Wyodak facility; a FEED study for an amine-based carbon capture retrofit at Jim Bridger Units 3 and 4; and that the Commission decline to require a specific low-carbon portfolio standard at this time.

OFFICIAL COUNTY COMMISSIONERS’ PROCEEDINGS

APRIL 2, 2024

The Board of County Commissioners met in regular session in the Lovatt Room of the Sublette Count Library on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Jeness Saxton, Clayton Melinkovich, Cali O’Hare, representing the Pinedale Round-up, and Carrie Long, County Clerk, present. 

The agenda was approved on motion by Commissioner Noble, seconded by Commissioner Bradley.

The minutes from the previous meeting on March 19, 2024, were approved and ordered filed on motion by Commissioner Vickrey, seconded by Commissioner Bradley. 

Billy Pape, Road & Bridge, updated the Board on department activities.  He also presented a pro-posal for construction of sand sheds (not including flooring) in the amount of $340,500 each. Pape was instructed to get estimates for the removal of the current structure and discuss at the next meet-ing.   

In accordance with public notice published in the Pinedale Roundup on March 28, 2024, public hearing was held for the transfer of funds in the amount of $698,512.56 from the following ac-counts:  Equipment Reserve, $621,926.00; Unanticipated Revenue, $8,469.00; Budget Shortfall Re-serve, $9,510.44; Elections Depreciation, $18,554.00 and Tax Refunds Depreciation, $40,053.12 to supplement the following accounts:  Heavy Equipment Purchase, $621,926.00; Courthouse – Insur-ance on Buildings, $9,510.44; Sheriff’s Office – Equipment Purchase, $5,000.00; County Clerk – Election Training, $3,469.00; County Clerk – Election Annual Dues, $18,554.00; and Charitable Relief Program, $40,053.12.  It was moved by Commissioner Bradley, seconded by Commissioner Noble, to approve Resolution 23-100480W. 

Andre Irey, Maintenance – updated the Board on department activities.  He stated the Kismet gen-erator is still not running properly.

Commissioner Noble made a motion to approve a Catering Permit for the Eagle Bar, LLC for the LaBarge Mt. Bash on April 13, 2024, and a Malt Beverage Permit for WYLD Dance Company for a Fundraiser Banquet at the Boulder Community Center on April 20, 2024.  Commissioner Bradley seconded the motion.  Motion carried. 

Surety Bond for Mosquito Abatement District #1 was approved on motion by Commissioner Brad-ley, seconded by Commissioner Noble.  Motion carried. 

Payroll, in the amount of $1,167,906.11 was approved on motion by Commissioner Noble, second-ed by Commissioner Bradley.  Motion carried.

Accounts Payable was approved on motion by Commissioner Noble, seconded by Commissioner Stephens.  Motion carried with Commissioner Bradley recusing himself from the vote. 

Grant Golden, Ice Arena Manager, updated the Board on department activities.  He informed the Board that a Junior League had inquired about using the Pinedale Ice Arena as a base with a pro-posal to lease ice time and space for activities.  Golden was instructed to move forward with the conversation and come back to the Board with more details. 

Clayton Melinkovich, County Attorney, presented contracts for Board approval.  The first was a Modification Agreement with the US Forest Service for an additional contribution of $15,000 for non-suppression / prescribed burn activities.  Commissioner Vickrey made a motion to approve the agreement, Commissioner Stephens seconded the motion.  Motion carried. 

Melinkovich also reviewed the S.I.R.S. maintenance contract.  Commissioner Bradley made a mo-tion to approve a five-year contract, Commissioner Noble seconded the motion.  Motion carried.  Signatures to be added later.

It was moved by Commissioner Noble, seconded by Commissioner Bradley to adjourn to Executive Session pursuant to W.S. 16-4-405(a)(iii) – Litigation.  Motion carried.

Open Session reconvened with no action from the Executive Session.

It was moved by Commissioner Bradley, seconded by Commissioner Stephens to adjourn to Execu-tive Session pursuant to W.S. 16-4-405(a)(ix) – Confidential Information. Motion carried. 

Open Session reconvened.  Chairman White stated the scholarship recipients have been selected and will be notified. 

Jeness Saxton, County Administrator, met with the Board, along with representatives from the Towns of Marbleton, Big Piney, and Pinedale regarding Consensus Funding.  Commissioner Noble made a motion to approve the Joint Resolution.  Commissioner Bradley seconded the motion.  Mo-tion carried. 

Saxton also updated the Board on department activities. 

Commissioners updated on Old Business.

Dennis Fornstrom, Planning & Zoning, presented items for Board consideration.  The first item was an application from Judith Roye c/o Henry Roye, requesting a Minor Subdivision, creating two 19.5 acre lots at 52 Bartec Rd.  Commissioner Noble made a motion to approve the application with the proposed condition of wildlife friendly fencing.  Commissioner Vickrey seconded the motion.  Mo-tion carried.

The next item was an application from K Cross Properties, LLC requesting a Change of Zoning Dis-trict Boundary for property located at 44 Snowshoe Trail that would reclassify 5.0 acres from A-1, Agriculture Zoning to RR-5, Rural Residential 5 Acre Zoning.  Commissioner Noble made a motion to approve the application.  Commissioner Bradley seconded the motion.  Motion carried.

Fornstrom presented an application from K Cross Properties, LLC proposing a Minor Subdivision of Lot 25 of the Forty Rod Ranches Subdivision, located at 44 Snowshoe Trail.  Commissioner No-ble made a motion to approve the subdivision as presented.  Commissioner Bradley seconded the motion.  Motion carried.

Fornstrom presented an application from the Jackson Fork Ranch, LLC requesting a Conditional Use Permit for a Parking Facility to be located within NW, NW of Sec 34, T37N, R113W, 6th PM for accommodation of a portion of the required parking for the Jackson Fork Resort project. 

Forstrom instructed the Board that the first question to be answered before the C.U.P. could be ap-proved was whether the Resort Parking Facility is a similar use as currently defined as ‘Industrial Transportation Parking Facility’.

Steve Christiansen, representing the Jackson Fork Ranch, gave a presentation on the proposed park-ing facility. 

Public comment: Chris Lacinak, Lisa Krall, Tyler Maxfield, Pat Burroughs, Bill Tanner, Marilyn Fil-kins, Dave Burnett, Rick Melby, Chad Mitchell, Dan Smitherman, Paul Ulrich, John Carter, Mack Rawhouser, Alan Blackburn, Dan Bailey, Joy Ufford, Mike Crosson, Mark Prus, Gary Darlick and Ken Konichek. 

Commissioner Vickrey made a motion to deny the request that the proposed parking facility was a similar use as an industrial parking facility.  Commissioner Stephens seconded the motion.  Motion failed, 2 to 3, with Commissioners Noble, White and Bradley voting nay. 

Commissioner Noble made a motion to acknowledge that the parking facility is a similar use as an industrial parking facility.  Commissioner Bradley seconded the motion.  Motion carried, 3 to 2 with Commissioners Vickrey and Stephens voting nay. 

Commissioner Bradley made a motion to approve the conditional use permit with no conditions at-tached.  Commissioner Noble seconded the motion with a condition of dust mitigation during the construction of the facility and no construction activity before 7:00 a.m. or after 7:00 p.m. on the facility or the road.  Commissioner Bradley was favorable to the amendment.  Commissioners White, Noble, and Bradley stated they have considered the necessary criteria and arrived at a favor-able conclusion.  Motion carried, 3 to 2, with Commissioners Vickrey and Stephens voting nay.

The meeting adjourned at 4:20 p.m.

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules and Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) requesting authority to increase rates to recover deferred Net Power Costs (NPC) under Tariff Schedule 95; and to increase rates pursuant to Tariff Schedule 93, Renewable Energy Credits (RECs) and Sulfur Dioxide (SO2) emission allowances, as more fully described below:

1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming under certificates of public convenience and necessity issued by the Commission. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(C) and 37-2-112.

2. On April 15, 2024, RMP filed an Application requesting authority to revise rates pursuant to two different rate schedules. The Company proposes to increase its Tariff Schedule 95 Energy Cost Adjustment Mechanism (ECAM) rates by approximately $84.3 million to recover de-ferred NPC. The Company also proposes to increase its Tariff Schedule 93 REC and SO2 Revenue Adjustment Mechanism (RRA) rates by approximately $2.1 million to account for sales of RECs and SO2 emission allowances. The Company requests interim approval of the proposed rates effec-tive for usage on and after July 1, 2024, subject to further review.

3. The following table summarizes the proposed price changes by tariff rate schedule. Within each rate schedule, the percentage change to individual customers may be higher or lower than the average due to rate design, customer load factors, and usage characteristics. The combined effect of the 2024 RRA and ECAM in this Application represents an overall proposed rate increase of approximately $86.4 million or approximately 12.3 percent.

TO ALL PERSONS INTERESTED IN SAID ESTATE:

You are hereby notified that on the 19th day of April, 2024, the Last Will and Testament of Donald Edward Westbrook was admitted to probate by the above-named Court, and that James L. Westbrook was appointed Personal Representative thereof.  Any action to set aside the Will shall be filed in the Court within three months from the date of the first publication of this notice, or thereafter be forever barred.   

Notice is further given that all persons indebted to said decedent or to said estate are requested to make immediate payment to Long Reimer Winegar LLP, 724 Front Street, Suite 200, Evanston, Wyoming, 82930.

Creditors having claims against said decedent or the estate are required to file them in duplicate with the necessary vouchers, in the office of the Clerk of said Court, on or before three months after the date of the first publication of this notice, and if such claims are not so filed, unless otherwise allowed or paid, they will be forever barred.
