Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Special Regulations, notice is hereby given of the Application of Rocky Mountain Power (RMP or the Company) for approval to adjust Category 1, 2, and 3 Demand Side Management (DSM) Surcharge Rates in electric service Schedule 191, the Customer Efficiency Service Charge, effective April 1, 2024.

  1. RMP is a division of PacifiCorp, an Oregon corporation, engaged in the business of supplying electric utility service to customers throughout its six-state service territory, including Wyoming. RMP is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(C) and 37-2-112.
  2. On February 2, 2024, RMP filed an Application requesting the Commission approve its proposed adjustment to Category 1, 2, and 3 DSM surcharge rates in tariff Schedule 191. The Company stated, in the Application, the adjustment is to align with the 2024-2026 DSM plan approved by the Commission in Docket No. 20000-632-ET-23, and to comply with the 2023 Order issued with that docket in which the Company is to file updated rates intended to recover costs associated with the approved offerings.
  3. RMP submitted exhibits reflecting over and under collected balancing account amounts, actual balancing account results through November 2023, and forecasted results through December 2026 using current Category 1 and 2 rates in tariff Schedule 191. Category 1 is estimated to be over collected by $872,943 and Category 2 is estimated to be under collected by $270,247.
  4. To address the over and under collected balances, the Company proposed revisions to Schedule 191 decreasing Category 1 and increasing Category 2 rates to 2.33 percent and 2.27 percent, respectively, effective April 1, 2024. RMP also proposed to decrease rates for Category 3 customers to 1.03 percent, 1.12 percent, and 1.21 percent in compliance with the 2023 Order. The revised rates for Category 3 customers will be effective April 1, 2024, and then January 1st of each following year of the 3-year DSM plan.

(CMP100826) to modify and operate the Riverside 11-14 PAD (F015403) by updating the equipment list, with three reboiler overheads condensers and one smokeless combustion device to control volatile organic compound and hazardous air pollutant emissions associated with the dehydration units, located in the NE1/4SW1/4 of Section 14, T31N, R109W, approximately seven (7) miles south-southwest of Boulder, in Sublette County, Wyoming.  PureWest Resources, Inc. has met the demonstration requirements under Chapter 6, Section 2(c)(ii) for this permitting action since current emissions are less than emissions during the baseline period.  VOC emissions have decreased 4.6 TPY from the baseline period and NOx emissions have decreased 14.3 TPY from the baseline period.  These reductions have been added to PureWest Resources, Inc.’s offset bank to use for future permitting actions.

The Town Council of the Town of Pinedale met in regular session on Monday, February 26, 2024, in the conference room of the Pinedale Town Hall.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present:  Tyler Swafford, Judi Boyce and Scott Kosiba.  Dean Loftus, absent; excused.  Those in attendance included:  Sheriff KC Lehr, representing Sublette County Sheriff’s Office; Mandy Moffat, representing SAFV Task Force; Chauncey Goodrich, representing Wind River Resorts; Peg Weber; Ed Wood, Town Attorney; and Town employees Spencer Hartman, Kevin Mitchell, Emily Leniger, Chad Mitchell, and Riley Wilson. Attending online were Brian Gray, representing Jorgensen Associates; Cali O'Hare, representing the Pinedale Roundup; Tesa Manning, Mark and Teri Helm; Lindsey Gooch; and Kolja Rockov.

Mayor Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Swafford to amend the agenda to add F-6, Housing Authority Discussion.  Seconded by Councilwoman Boyce.  Motion passed 4-0.

Motion by Councilwoman Boyce to approve the February 12, 2024, regular Town Council meeting minutes.  Seconded by Councilman Kosiba.  Motion passed 4-0.

Sheriff Lehr reported on calls for service for January 2024.

A Contract for Services presentation was given by Mandy Moffat for the SAFV Task Force.

Motion by Councilman Kosiba to approve the consent agenda items as published.  Seconded by Councilman Swafford.  Motion passed 4-0.  Consent agenda items approved were the 2024 Fire Extinguisher Maintenance contract with State Fire DC Specialties, in the amount of $3,072.60; the Aviation Fuel Supplier RFQ for solicitation of an aviation fuel supplier at Ralph Wenz Field; and the Leaves of Diversity grant application through the Wyoming State Forestry Division 2024 Community Tree Planting Program, in the amount of $5,550 with a like local match.

A residential building permit for Lot 17 South Skyline Street was tabled until the March 11, 2024, council meeting.

Motion by Councilwoman Boyce to approve the migration of email and file sharing server from Google Suite to Microsoft by Sweetwater Technology, in an amount not to exceed $8,000.  Seconded by Councilman Swafford.  Motion passed 4-0.

Motion by Councilman Kosiba to approve the submittal of the Replacement of Damaged Sewer Lines on Jade Street and Shanley Avenue Project and the Wastewater Treatment Facility Rehabilitation Project to the State Land and Investment Board under the document, Needs Survey and Intended Use Plan (IUP).  Seconded by Councilman Swafford.  Motion passed 4-0.

Motion by Councilman Swafford to approve the Mayor's appointment of Councilman Scott Kosiba to the Pinedale Airport Board.  Seconded by Councilwoman Boyce.  Motion passed 3-0-1; Councilman Kosiba abstained.

Motion by Councilwoman Boyce to approve the Mayor's appointment of Councilman Dean Loftus to the Park and Tree Board.  Seconded by Councilman Kosiba.  Motion passed 4-0.

ORDINANCE NO. 707

AN ORDINANCE OF THE TOWN OF PINEDALE, STATE OF WYOMING AMENDING ARTICLE XIII OF CHAPTER 400 OF THE PINEDALE MUNICIPAL CODE TITLED ANNEXATION IN ITS ENTIRETY.

NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING, THAT ARTICLE XIII OF CHAPTER 400 TITLED “ANNEXATION” OF THE PINEDALE MUNICIPAL CODE IS HEREBY TO READ AS FOLLOWS:

ARTICLE XIII

Annexation

400-108  General.

The process of adding property to the Town is referred to in Wyoming State Statutes as “Annexation" at Article 4 of Chapter 1 of Title 15. The detailed requirements for annexations are found in the statutes following the reference, specifically at Wyoming State Statutes, W.S. § 15-1-401 et seq. through 15-1-423.  The provisions of the applicable Wyoming State Statutes shall govern and control in regard to annexations to the Town.

400-109  Annexation Agreement.

An annexation agreement between the Town a petitioning landowner or land developer, as applicable, may be required to annex land into the Town at the discretion of the Town Council. Typically, an annexation agreement will address the following, and may be subject to revision up to the time of final acceptance by the governing body:

  1. Identification of geographic area to be annexed by the Town;
  2. The financial obligation and timeline of the landowner to construct infrastructure to provide service to the annexed area and the requirement to construct such infrastructure in compliance with the requirements of the service provider;
  3. The landowner's consent to comply with all Town regulations, including, but not limited to, regulations pertaining to: drainage, erosion, and storm water management; fire protection and emergency response; refuse; snow removal; and nuisances;
  4. The landowner's consent to identify and provide public improvements necessary to facilitate the development and to address the impacts of the development on existing Town infrastructure and services;
  5. Set forth any further obligations placed upon the landowner and/or the Town as conditions of annexation;
  6. Such other matters as the Town shall deem necessary to address in regard to the protection of the health, safety and welfare of the persons residing in the area proposed to be annexed and in the Town.

400-110  Effective date of annexation.

The annexation of a territory shall become effective upon the date provided in the annexation ordinance.

400-111  Filing fee; costs.

Every annexation petition shall be accompanied by a filing fee as set by resolution.  In addition, an applicant shall reimburse the Town for all costs that the Town shall incur in regard to any annexation petition, including but not limited to cost of preparing annexation report, publication costs, and engineering and legal review.

This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.

THE TOWN OF PINEDALE, WYOMING, THAT ARTICLE XIV OF CHAPTER 400 TITLED WATER RIGHTS OF THE PINEDALE MUNICIPAL CODE IS HEREBY TO READ AS FOLLOWS:

  • 400-117 Deeding to Town.

Except as otherwise provided for in this ordinance, all direct flow and storage rights attached to all land included in a subdivision or in an area to be annexed to the Town shall be deeded to the Town by water right deed prior to approval of the subdivision plat or prior to enactment of an annexation ordinance. The water right deeds shall be subject to the inspection and approval of the Town Attorney. The Town Council may cause the water right deeds to be redrafted to meet the satisfaction of the Town Council prior to approval of the plat or prior to enactment of an annexation ordinance.  The provisions of this ordinance may be waived by the Town Council in annexations where the Town Council deems it to the benefit of the Town.  This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.

The Wyoming Public Service Commission (Commission) approved the Application of Questar Gas Company, d/b/a Dominion Energy Wyoming (Dominion or the Company) to amortize the Conservation Enabling Tariff Balancing Account resulting in a rate increase to $0.02612 per dekatherm (Dth), for all General Service class customers, effective for usage on and after January 1, 2024.

The proposed change is based on the amortization of an over collected balance of $89,058.49 as of October 2023, and on a 12-month test year ending December 31, 2024. The Company’s proposal results in an annual increase of approximately $11.96 or 1.10% before taxes, for a typical residential customer using 80 Dth.

OFFICIAL COUNTY COMMISSIONERS’ PROCEEDINGS

FEBRUARY 20, 2024

The Board of County Commissioners met in regular session in the Commissioners’ Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Sam White, Tom Noble, Doug Vickrey, Dave Stephens, Mack Bradley, Jeness Saxton, Clayton Melinkovich, Cali O’Hare (via Teams Meeting) representing The Pinedale Roundup, and Carrie Long, County Clerk, present.

Chairman White led those present in the Pledge of Allegiance.

The agenda was amended on motion by Commissioner Noble, seconded by Commissioner Vickrey, to add Ken Konicek for Shelter Park improvement discussion and to change the Executive Session notation to 16-4-405(a)(ix).  Motion carried. 

The minutes from the previous meeting on February 2, 2024, were approved and ordered filed on motion by Commissioner Vickrey, seconded by Commissioner Stephens. 

Billy Pape, Road & Bridge, updated the Board on department activities.  Chairman White requested Pape find out about the total cost of the proposed Waste Management Grinder. 

Andre Irey, Maintenance, updated the Board on department activities.  Commissioner Vickrey asked for follow up on the parking issue on Mill Street.  Irey said he would probably change the park into a parking lot to accommodate county janitorial vehicles. 

ML Baxley, Unified Fire – presented a contract for the de-obligation of funds in the amount of $8474.64.  Commissioner Bradley made a motion to approve the contract, Commissioner Noble seconded the motion.  Motion carried. 

KC Lehr, Jeness Saxton, Andre Irey, and Mark Warner (representing Rocky Mountain Communication Systems) updated the Board on the agreement for radio maintenance for the S.I.R.S. project. 

Public Hearing was held at 10:00 a.m. for the transfer of a Retail Liquor License from Laura’s Place, LLC to Nona’s Place, LLC.  There were no protests regarding the transfer.  Gil Winters, owner of Laura’s Place stated the sale of the property had not been finalized and requested the transfer be approved but no liquor issued until the sale is finalized.  Commissioner Noble made a motion to approve the transfer, and Commissioner Bradley seconded the motion.  Motion carried. 

Ken Konicek, representing the Lions Club, stated that the Club would like to finance some improvements at Shelter Park.  Chairman White directed that Konicek contact Andre Irey to discuss options. 

Jeness Saxton, County Administrator, updated the Board on department activities. 

Andrea Jean, Human Resources, discussed options for Harassment Training.  She was directed to obtain a contract for further review. 

Levi Lozier, representing the Golf Committee, discussed the possibility of Golf Course employees being converted to County Employees.  Chairman White directed Lozier to meet with the county clerk to discuss the revenues and expenses of the Golf Course and the possible scenarios of organization.

BIDS will be received by Rio Verde Engineering until 2:30 pm local time on Thursday, May 2nd, 2024, at which time said BIDS will be opened and read aloud.

The work consists of removing and replacing 76 damaged steel delineators, removing 174 fiberglass delineators and replacing with steel delineators and installing 274 new delineators across 6 county roads. 

CONTRACTORS shall be required to accompany each bid with a BID Bond with sufficient surety, or a certified check, cashier’s check or bank draft upon some reputable bank payable to Sublette County for at least ten (10) percent of the total amount of the BID.  The bond, check or bank draft shall be forfeited as liquidated damages, if the CONTRACTOR, upon the letting of the contract to him, fails to enter into the contract within ten (10) days after it is presented to him for that purpose or fails to proceed with the performance of the contract.  The BID Bond, draft or check shall be retained by Sublette County until proper bond to secure performance of the contract has been filed and approved.  All the above is to be in accordance with 15-1-113 and 16-6-101 to 121, Wyoming Statutes, 2024.

Sealed BIDS are requested for work described in the Project Manual for the 2024 Sublette County Centerline Striping Project, dated March 21, 2024, prepared by Rio Verde Engineering, 804 Hoback Street, P.O. Box 642, Pinedale, Wyoming 82941, 307-367-2826.

BIDS will be received by Rio Verde Engineering until 2 pm local time on Thursday, May 2nd, 2024, at which time said BIDS will be opened and read aloud.

The work consists of painting the centerline on the Forty Rod CR 23-149 and the Fayette Pole Creek CR 23-121.  Total length of centerline striping is approximately 8.91 miles.

CONTRACTORS shall be required to accompany each bid with a BID Bond with sufficient surety, or a certified check, cashier’s check or bank draft upon some reputable bank payable to Sublette County for at least ten (10) percent of the total amount of the BID.  The bond, check or bank draft shall be forfeited as liquidated damages, if the CONTRACTOR, upon the letting of the contract to him, fails to enter into the contract within ten (10) days after it is presented to him for that purpose or fails to proceed with the performance of the contract.  The BID Bond, draft or check shall be retained by Sublette County until proper bond to secure performance of the contract has been filed and approved.  All the above is to be in accordance with 15-1-113 and 16-6-101 to 121, Wyoming Statutes, 2024.

The right is reserved by Sublette County to reject any and all BIDS, and to waive any irregularity or informality in the BID process.  BIDS may not be withdrawn for thirty days after the date of opening.

NOTICE OF PUBLIC MEETING

The Town of Pinedale, Wyoming, will conduct a public meeting at 5:00 PM, local time, on April 8, 2024, in the Town Council Chambers located at Pinedale Town Hall, 205 Entertainment Lane, Pinedale, WY 82941. The purpose of the meeting is to allow citizens to review and comment on the following: 1) the Pinedale Shallow Water Main Sewer Replacement Project, and 2) the Wastewater Treatment Facility Rehabilitation Phase 1 and Phase 2 Engineering Project. 

The Pinedale Shallow Water Main Sewer Replacement Project consists of removal of existing sewer mains and services beneath Shanley Avenue and Jade Street and replacement with approximately 1100 linear feet of eight and ten-inch diameter pipe. Work includes the completion of necessary surface repairs due to the location of the underground infrastructure and is anticipated to be constructed in fall 2024 in conjunction with the Shallow Water Main Replacement Project.

The Wastewater Treatment Facility Rehabilitation Phase 1 and Phase 2 Engineering Project will remove and replace deteriorated anaerobic pond covers and the UV disinfection system which has reached the end of its useable life, upgrade the bulk septic receiving to further protect the treatment equipment and treatment train, and install an outlet diffuser to improve mixing discharge waters across Pine Creek. The Phase 2 Engineering portion of the project will include the engineering design of a secondary treatment upgrade to the Wastewater Treatment Facility pursuant to the findings of the Wastewater Treatment Master Plan to reduce discharge of ammonia and other discharge parameters regulated by the Town of Pinedale WYPDES permit with WYDEQ. It is anticipated that the work will be completed in 2025.

At the meeting, the Town of Pinedale will present the preliminary designs of the proposed projects and will discuss the estimated costs of the improvements and the plans for funding the improvements. Preliminary plans of improvements, cost estimates, and the funding plans can also be obtained for review by contacting the office of Nelson Engineering, 430 S Cache St, Jackson, WY. Based on current cost estimates, the Town of Pinedale plans to borrow $294,834 from the Wyoming Clean Water State Revolving Loan Fund for the Pinedale Shallow Water Main Sewer Replacement Project and $1,895,350 for the Wastewater Treatment Facility Rehabilitation Phase 1 and Phase 2 Engineering Project administered by the Wyoming Office of State Lands and Investments. Increased user fees and reserves from the sewer enterprise fund will repay the loan. The average rate increase is estimated to be $0.80/month per user to repay the sewer loan and $4.39/month per user to repay the WWTF loan. Loan terms will be, at maximum, 1.5% interest rate and 30 years.
