Whereas High Country Behavioral Health (HCBH), a private, non-profit organization, is the Grantee of the Community Services Block Grant (CSBG) for the Lincoln and Sublette County areas;

Whereas High Country Behavioral Health will be submitting said application for FY 2022 to the Wyoming Department of Health, Wyoming Community Services Program, which said application is due May 24, 2022;

Whereas Chereon Hoopes is the employee coordinating the CSBG services and funds allocated from the grant as directed by the Tripartite Board;

The Town Council of the Town of Pinedale met in regular session on Monday, April 25, 2022, in the Lovatt Room of the Sublette County Library.

The meeting was called to order by Mayor Matt Murdock at 5 p.m. Council members present:  Judi Boyce, Isaac Best, Tyler Swafford and Dean Loftus. Those in attendance included: Representative Albert Sommers; Bobby Lang, representing the Sublette County Sheriff;  Robert Galbreath, representing the Pinedale Roundup; Joanie Christie, representing Sublette County Chamber of Commerce; Brian Gray, representing Jorgensen Associates; and Town Director of Public Works, Abram Pearce; Max Lockett; and Morgan and Marc Faber. Rosemary Corbin; Stacie McDonald and Tyke Hart, representing Union Wireless attended via teleconference.

Mayor Matt Murdock led those present in the Pledge of Allegiance.

Motion by Councilman Swafford to accept the agenda as presented. Seconded by Councilman Loftus. Motion passed 5-0.

Motion by Councilwoman Boyce to approve the minutes of the April 11, 2022, regular Town Council meeting as presented. Seconded by Councilman Swafford. Motion passed 4-0-1. Best abstained.

Representative Sommers reported information from the legislature.

Deputy Lang reported on calls for service for March 2022.

Motion by Councilman Best to approve the purchase of trees funded by the 2022 Forestry Grant from Teton Turf & Tree in the amount of $6,875. Seconded by Councilwoman Boyce. Motion passed 5-0.

Arbor Day is May 19, 2022, and will be held at the Dudley Key Sports Complex in Pinedale.

Motion by Councilman Swafford to approve the purchase of laboratory supplies in the amount of $2,556.81 from Idexx. Seconded by Councilman Loftus.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve the purchase of soda ash 10% from Brenntag Pacific in the amount of $6,640. Seconded by Councilman Best. Motion passed 5-0.

Motion by Councilwoman Boyce to approve the Teletractors, Inc. Change Order No. 2 for the South Tyler Pathway Project in the amount of $7,200. Seconded by Councilman Best. Motion passed 5-0.

Council discussed a potential kayak course and hydro-electric plant on Pine Creek with funding from the State Recreation Department.

Council discussed the Town picnic and fireworks for the 4th of July celebration.

Motion by Councilwoman Boyce to approve the Jackson Avenue Park contract with Green River Outfitting effective 05/01/2022 through 04/30/2025. Seconded by Councilman Best. Motion passed 5-0.

Motion by Councilman Swafford to approve the Granicus Software contract in the amount of $2,840.97 effective 06/22/2022 through 06/21/2023. Seconded by Councilman Loftus. Motion passed 5-0.

Motion by Councilman Swafford to approve the Right-of-Way Permit application from Visionary Communications for excavation at 513 West Wilson Street and proceed with the project as presented. Seconded by Councilman Loftus. Motion passed 5-0.

Motion by Councilman Loftus to approve the Temporary Use Permit application for sewer service connection on South Sublette Avenue. Seconded by Councilman Swafford. Motion passed 5-0.

Motion by Councilwoman Boyce to approve the Temporary Use Permit application by Main Street Pinedale for closure of South Fremont St., from Pine St. through Mill St., July 6-10, 2022. Seconded by Councilman Best. Motion passed 5-0.

Motion by Councilman Best to approve the Temporary Use Permit application & WYDOT Special Event application from Main Street Pinedale for closure of Pine Street east bound parking from Tyler Ave. to Fremont St., July 6-10, 2022. Seconded by Councilman Swafford. Motion passed 5-0.

Motion by Councilman Best to approve the Temporary Use Permit application & WYDOT Special Event application from Main Street Pinedale for closure of Pine Street from mile post 99 to mile post 100 on July 9, 2022, from 11 a.m. until 12:15 p.m. Seconded by Councilman Swafford. Motion passed 5-0.

Motion by Councilman Best to table the request to close North Maybell from Pine St. to Magnolia, July 7-10, 2022. Seconded by Councilwoman Boyce. Motion passed 5-0.

Motion by Councilwoman Boyce to table the request for extended hours of amplified noise on July 10, 2022. Seconded by Councilman Best.  Motion passed 5-0.

Motion by Councilwoman Boyce to approve Ordinance 700, on second read, an ordinance of the Town of Pinedale, State of Wyoming, amending section 475-93.1 to remove rental restrictions on accessory dwelling units in the R-4 zoning district. Seconded by Councilman Loftus. Motion passed 5-0.

ORDINANCE NO. 700

AN ORDINANCE OF THE TOWN OF PINEDALE, STATE OF WYOMING, AMENDING SECTION 475-93.1 TO REMOVE RENTAL RESTRICTIONS ON ACCESSORY DEWELLING UNITS IN THE R-4 ZONING DISTRICT.

NOW, THEREFORE BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PINEDALE, WYOMING THAT SECTION 475-93.1 OF CHAPTER 475 OF THE PINEDALE MUNICIPAL CODE IS HEREBY AMENDED TO READ AS FOLLOWS:

475-93.1 Conditions on accessory dwelling units (ADU).

  1. Construction and use of an ADU shall not be permitted if not allowed by private covenants, conditions and restrictions (as applicable) and such fact is known by the Town.
  2. If rented, the ADU must be rented on a monthly basis or longer; no daily or weekly rental is allowed.
  3. Only one ADU per single-family residence is permitted.

This Ordinance shall be in full force and effect from and after passage on three readings and publication according to law.

OFFICIAL COUNTY COMMISSIONERS’ PROCEEDINGS

APRIL 19, 2022

The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse on this date at 9:00 a.m. with Joel Bousman, Tom Noble, Doug Vickrey, Sam White, Dave Stephens, Matt Gaffney, Clayton Melinkovich, Brady Oltman representing the Pinedale Roundup, and Carrie Long, County Clerk, present. 

Chairman Bousman led those present in the Pledge of Allegiance. 

The agenda was approved on motion by Commissioner Noble, seconded by Commissioner Vickrey.  Motion carried. 

The minutes from the previous regular meeting held on 4/5/22 were approved and ordered filed on motion by Commissioner Stephens, seconded by Commissioner White.  Motion carried. 

Billy Pape, Road & Bridge, updated the Board on activities.  Pape requested direction on a request he received for Road & Bridge personnel to level some dirt at the Big Piney Gun Club, he was directed to proceed with the request. 

A motion was made by Commissioner Noble, seconded by Commissioner White to move forward with the State in replacing the New Fork River Bridge on CR 23-175.  Motion carried. 

Mark Tesoro, Southwest Wyoming Off-road Trails (SWOT), along with Jordan Wessler, Westside Regional Supervisor for the Trails Program and Pete Stinchcomb, WYDOT District 3 Engineer, gave a presentation on projects implemented in Uinta County and proposed projects for Sublette County.

Chairman Bousman directed County Administrator, Matt Gaffney, to work with the SWOT representatives and the local Snow Explorers Club to identify possible Sublette County projects.  

KC Lehr, Sheriff, met with the Board to request approval to submit a joint request with the Town of Pinedale to the Wyoming Department of Transportation to install, operate, and maintain two Radar Speed Feedback Signs along Us-191 in Pinedale.  The request was approved on motion by Commissioner White, seconded by Commissioner Noble.  Motion carried. 

Kristy Stoll, Williams Land Representative, met with the Board to request approval of an Easement across county property for a pipeline.  Commissioner White made a motion to approve the Easement upon final approval of the legal description from the County Attorney’s office and to allow the Chairman signatory authority between Commission meetings.  Commissioner Noble seconded the motion.  Motion carried.  

Peggy Winters, Mosquito Abatement District #1, met with the Board to discuss vacancies on the Board.  Commissioner White made a motion to advertise the appropriate number of vacant positions for Commission appointment.  Commissioner Noble seconded the motion.  Motion carried. 

Cat Urbigkit and Deanne Swain met with the Board to present their proposal for the FY23 State of the County Report.  It was moved by Commissioner Noble, seconded by Commissioner White to accept the proposal for 500 copies in the total amount of $13,260.00.  Motion carried with Commissioner Vickrey abstaining from voting. 

A motion was made by Commissioner Vickrey, seconded by Commissioner Noble to adjourn to Executive Session pursuant to W.S. 16-4-405 (a)(iii)(litigation).

The open meeting was resumed with no action from the Executive Session. 

Amber Anderson, Friends of the PAC, presented the TANF grant outline to the Board.  Commissioner White made a motion to approve the grant request in the amount of $48,500.00.  Commissioner Noble seconded the motion.  Motion carried. 

Accounts payable, in the amount of $1,062,974.85, was approved on motion by Commissioner White, seconded by Commissioner Noble.  Motion carried.

The Board discussed the proposed Resolution Establishing the Salaries for the Elected Officials of Sublette County for the Four-Year Term Commencing January 3, 2023.  Commissioner White made a motion to proceed with the publication of the Resolution as presented with the Assessor, Treasurer, Clerk, Clerk of District Court at $99,500.00 per year.  The Sheriff and County Attorney at $110,000 per year and the Commissioners at $35,000 per year. Commissioner Noble seconded the motion.  Motion carried 3-2 with Commissioners Vickrey and Stephens voting nay. 

Rich Greenwood, Greenwood Mapping, met with the Board via Zoom with a recommendation of accepting the proposal from Aero-Graphics, Inc. in the amount of $212,340.00 for digital ortho-imagery for Sublette County.  The recommendation was approved on motion by Commissioner Noble, seconded by Commissioner White.  Motion carried. 

A motion was made by Commissioner White, seconded by Commissioner Vickrey to approve the Doyle place lease with Darrell Snyder as presented.  Motion carried. 

The meeting concluded at 3:15 p.m.
