Living – Life – Large

The masses of humanity have lost their thirst for the truth. They turn their backs from the true evidence that is not compatible with the newly established pallet that has become all consuming. These confused people prefer to defy the truth and accept error that is constantly being supplied to them from false illusions.

Our country is being overrun with lawsuits from people who want to blame someone every time something goes wrong. People are suing for anything and everything because there are not any consequences if they lose. Frivolous lawsuits are abundant and harmful.

People are flooding the legal process with senseless litigation and apparent disregard for the merit of their own arguments.

A 17-year-old senior high school student from Los Angeles is suing her school district and the United States Department of Agriculture for violating her First Amendment rights after she was told she could only promote non-dairy milk if she also promoted animal-based milk.

The First Amendment provides that Congress make no law restricting an establishment of religion or prohibiting its free exercise. It protects freedom of speech, the press, assembly and the right to petition the government for a redress of grievances.

She asked school officials if she would be allowed to host a “day of action” promoting and distributing information about the benefits of non-dairy milk.

She was told that she could, but would also have to provide information about the benefits of dairy milk, which she said defeated the purpose of the event and therefore violated the First Amendment.

By compelling her, with fairness of the complete picture, to simultaneously distribute the dairy information that she seeks to refute, the Defendants have violated her free speech rights.

This is just a current frivolous lawsuit, but we have been plagued with many. Like a common social disease, we all have been infected or know someone close to us that has.

A woman sued Kraft Heinz Co. because she says Velveeta’s microwavable mac and cheese cups are not “ready in 3 and 1/2 minutes.” In the lawsuit, the woman claims the time on the front of the package does not include other “time-consuming” steps such as tearing off the lid.

Altoids was sued because someone claimed the mints don’t have real cinnamon even though the front of the tin clearly says that they are artificially flavored. Kroger was sued over claims that their smoked Gouda cheese only tastes smoked but isn’t smoked over wood. Kellogg’s was also sued because some fruit-nut claimed that there were not enough strawberries inside their Strawberry Pop-Tarts.

Suing has become so common in the U.S. because there are no consequences if you lose. Frivolous lawsuits are abundant and harmful. Any person can sue anybody for almost any reason by just filing the suit and paying the nominal court costs. Then, it is up to the other person who has to mount a defense.

Creative people, problem solvers and manufactures, are becoming timid and in the long run we all are paying the price. There are many life-enriching products that aren’t being put on the market because of fear of litigation.

One company developed a fire-resistant substitute for asbestos but is too afraid to release it to the public. Vaccine companies are also on the defensive in order to avoid lawsuits. The FDA has approved a vaccine for Lyme disease but no company is willing to take the risk to distribute it. Another company invented a portable kidney dialysis machine. Instead of visiting the hospital regularly, people with kidney disease could have the dialysis procedure done in the convenience of their own home.

It’s about choice. Shouldn’t informed individuals be able to assume the risks of these products if they so choose? Companies should be able to provide these life-enhancing products without fear that the few who do not benefit from them might put them out of business?

We need to take responsibility for our actions and carefully weigh the risks without depending on a monetary reward from a lawsuit if something goes wrong. So too should the massive amount of lawyers flooding the system need to shoulder some blame. Stop the billboard advertising about how much money you get for an accident happening and choose cases of honesty instead of merely seeking the highest financial reward.

I’ve come to know the feeling of exhaustion as I see and live through the options and potentials expressed from all possible perspectives. I believe in freedom of thought, mind and action. I believe in truth and justice. However, I am starting to feel loose with the belief that we control our destiny. I see humanity stumbling, falling and losing direction in what is now the anarchy of social disorder while waiting for the philosopher king. Looking for hope to once again become wrapped in the wonderment of having faith. Perhaps though, there is a pending lawsuit with the philosopher king making us wait so long - dbA
