SUBLETTE COUNTY – Jailed since his Aug. 31 arrest for attempted second-degree murder and assault charges, Nicholas A. Leyva, of Daniel, pleaded not guilty to seven counts at his Oct. 6 arraignment in 9th District Court.
Leyva was arrested after law enforcement and Sublette EMS responded to an emergency call from neighbors of Leyva and his husband, Dr. Stephen Buck Wallace. They apparently argued and Leyva allegedly assaulted Wallace, injuring his trachea and cutting off his breathing. Wallace drove to the neighbors, where he collapsed and asked them to call a paramedic; AirIdaho flew Wallace to Eastern Idaho Regional Medical Center. He was treated for injuries and released Sept. 2, according to Sublette County Detective Travis Lanning.
Leyva, initially held in lieu of $500,000 cash or surety bond, first appeared in Sublette County Circuit Court before Judge Curt Haws for a preliminary hearing.
There, Lanning testified about the neighbors’ and Wallace’s sequence of events leading to the charges. Judge Haws bound the case to 9th District Court.
At his Oct. 6 arraignment, Leyva requested a jury trial, which Judge Marv Tyler scheduled for five days to begin Monday, March 13, 2023, court records show.
On Oct. 7, Judge Tyler amended Leyva’s bond to $100,000 cash only with the term “new money” with numerous restrictions that include Leyva wearing an electronic tracking device, not violating laws, not carrying firearms or other item that could stun, drug or incapacitate any living thing. Other release terms would include staying 150 feet from Wallace or the neighbors and remaining in Sublette County without prior permission.
Leyva remained in custody at the Sublette County Detention Center at press time.
