FORECLOSURE SALE NOTICE

WHEREAS NOTICE IS HERBY GIVEN that a default in the payment under the terms of a secured and perfected Note has occurred.  The Note is secured by a Mortgage dated December 14, 2009 and recorded on December 17, 2009 at REC # 346459 Book 176 Mtg., Page 604 in the records of Sublette County, Wyoming from James Cochran and Rebecca L Dennis, to Mortgage Electronic Registration Systems, Inc., as nominee for Bank of America, N.A. for the amount of $178,571.00.  The Mortgage having been assigned to and now in possession of Carrington Mortgage Services, LLC, through assignments recorded on January 3, 2012 at REC# 358481 Book 188 Mtg., Page 588 and July 29, 2019 at REC# 399207 Book 237 Mtg., Page 23 in the records of Sublette County, Wyoming.

OFFICIAL COUNTY COMMISSIONS PROCEEDING

DECEMBER 3, 2019

The Board of County Commissioners met in regular session in the Commissioners Meeting Room of the Sublette County Courthouse on this date at 9:00 A.M. with David Burnett, Joel Bousman, Mack Rawhouser, Doug Vickrey, Mike Crosson, County Attorney, Clayton Melinknovich, Matt Gaffney, Skylar Wilson, Holly Dabb representing the Pinedale Roundup, and Carrie Long, County Clerk, present.  Commissioner Noble was excused.

Chairman Burnett led those present in the Pledge of Allegiance.

It was moved by Commissioner Bousman, seconded by Commissioner Vickrey to approve the agenda with the deletion of discussion from Sheriff Lehr regarding flex time.  Motion carried.

The minutes of the regular meeting on November 19, 2019 were approved and ordered filed on motion by Commissioner Rawhouser, seconded by Commissioner Bousman.  Motion carried. 

Billy Pape, Road & Bridge Superintendent, updated the Board on recent activities.  He also presented two Resolutions to the Board for consideration.  It was moved by Commissioner Bousman, seconded by Commissioner Rawhouser to approve Resolution No. 19-100372B (Amending the Speed Limit on CR 23-236 – Iroquois Lane) and Resolution No. 19-100373B (Amending the Speed Limit on CR 23-234 – Meadowlark Lane).  Motion carried. 

Eric Sackett, representing Rio Verde Engineering, met with the Board to update on Cottonwood Ryegrass project.  He stated the design is coming together and should be ready to submit to the Corp of Engineers later in the week.

Matt Gaffney, County Administrator, met with the Board to discuss several items.  The first item presented was a Request for Proposal for the Owner’s Representative Contract currently held by Forsgren Associates, Inc.  The second RFP was for the Road and Engineering Services Contract currently held by Rio Verde Engineering.  The third RFP was the Replacement of the County’s Telecommunications System.  It was moved by Commissioner Bousman, seconded by Commissioner Rawhouser to approve all three RFPs.  Motion carried. 

It was moved by Commissioner Rawhouser, seconded by Commissioner Bousman to approve a public advertisement for the County Health Officer position.  Motion carried unanimously. Chairman Burnett instructed Gaffney to contact the current County Health Officer and inform him of the application process. 

Commissioner Bousman made a motion the Board consider approving $5000 to provide a facilitator for the Forest Collaborative and Matt Gaffney be allowed to pursue a grant from the Federal Natural Resource Policy Account (F.N.E.R.P.A.) in order to reimburse the cost. Commissioner Rawhouser seconded the motion.  Motion carried. 

Shad Cooper, Fire Warden, and Wil Gay, Deputy Fire Warden, met with the Board to update on activities.  Cooper explained to the Board he and Commissioner Bousman are in the exploratory phase of working with State Forestry and the USFS to provide good neighbor authority projects; specifically, timber sales in the Upper Green.

Wil Gay requested direction from the Board with respect to excess and outdated equipment at the different fire stations.  Gay explained some of the equipment could be donated to other fire departments, and some could be auctioned.  Chairman Burnett instructed Gay and Cooper to move forward with disposing of the equipment that is not usable, donating if appropriate and saving for auction if appropriate.

Tracey Hoover, Deputy County Clerk, met with the Board to request approval of the transfer of the Retail Liquor License from High Plains Marina, LLC to Titan Adventures, LLC in accordance with the public notice in the Pinedale Roundup on November 22 & 29, 2019. Commissioner Bousman made a motion to approve the request, contingent of the sale of the High Plains Marina, LLC to Titan Adventures, LLC at the end of December, 2019. Commissioner Rawhouser seconded.  Motion carried. 

Hoover also requested approval of a Catering Permit to Eagle Bar for an event that occurred on November 23.  Commissioner Rawhouser made the motion to approve the request, Commissioner Bousman seconded.  Motion carried.

It was moved by Commissioner Bousman, seconded by Commissioner Rawhouser to approve Accounts Payable.  Motion carried.

Jeness Saxton, County Assessor, presented one Tax Roll Correction for Hilcorp Energy Company for a decrease of $2,293.16.

Emily Paravicini, County Treasurer, presented two Bonds for approval:  Marilyn Jensen, Treasurer, for the Boulder Mosquito Improvement District; and Amy Commerer, Superintendent / Clerk, for the Big Piney Cemetery District.  Commissioner Bousman made a motion to approve both bonds, Commissioner Vickrey seconded.  Motion carried. 

It was moved by Commissioner Rawhouser, seconded by Commissioner Bousman to appoint Josh Adams as the Sportsman representative on the Predator Board. Motion carried.

Clayton Melinkovich, Deputy County Attorney, met with the Board to review the tabled transfer of property to Sublette County.  It was moved by Commissioner Vickrey, seconded by Commissioner Rawhouser to accept the property from Crown S Land Holdings, LLC.  Motion carried.

It was moved by Commissioner Bousman, seconded by Commissioner Rawhouser to recess to Executive Session pursuant to W.S. 16-4-405(a)(iii).  Motion carried. 

The Board resumed regular session; no action taken.

Old Business:

Commissioner Rawhouser stated he had attended a meeting regarding Chronic Wasting Disease.

Commissioner Bousman stated he had been appointed by prior Governor Mead to serve as a board member on the Pinedale Anticline Project Office and continues to serve.

Commissioner Vickrey said he had attended a Library Board meeting and will follow up with discussion regarding upgrades and repairs.

Matt Murdock, Mayor of the Town of Pinedale, and Jim Washam, met with the Board to continue discussion regarding the purchase of additional slabs for the Veteran Memorial.  Murdock stated the Town is willing to pay the $25,000 deposit if a MOU could be developed.  Commissioner Bousman made a motion to move forward with an MOU between the Town and Sublette County regarding the deposit and purchase.  Commissioner Rawhouser seconded the motion.  Motion carried.

Dennis Fornstrom, Planning & Zoning Administrator, presented the Board with three Resolutions for approval:  Resolution No. 19-100369B – Daniel & Sharon Smitherman change of zoning district boundary; Resolution No. 19-100370B – LR Communications & Chad Kuhn condition use permit; Resolution No. 19-100371B – Freddie Botur conditional use permit.  Commissioner Vickrey made a motion to approve the three Resolutions.  Commissioner Bousman seconded the motion.  Motion carried.

Fornstrom submitted a request for a Conditional Use Permit pursuant to Chapter V of the Sublette County Zoning and Development Regulations to allow for the rental of his 4-bedroom home located at 20 Old Brazzill Ranch road, as an AIRBNB & VRBO Rental Property.  The Conditional Use would allow Mr. Moscinski to rent his property by the night, week or long term.  Fornstrom stated he is expecting a letter from the Home Owners Association in support of the Conditional Use.  It was moved by Commissioner Bousman, seconded by Commissioner Rawhouser to approve the Conditional Use contingent on the receipt of the letter of support.  Motion carried with Commissioner Vickrey voting nay. 

Fornstrom submitted a request from James H. & Valerie J. Kelson, Trustees & Joseph Avalon proposing the Vacation and Reconfiguration of Lot 3, 4 & 5 of the Kelson Minor Subdivision.  This proposal would then create Lots, 6, 7 & 8 of the Kelson Amended Minor Subdivision, pursuant to Chapter XII, Subchapter VI, Section 4, Vacation/Modifications to Filed Plats, of the Sublette County Zoning and Development Regulations.  It was moved by Commissioner Bousman, seconded by Commissioner Rawhouser to approve the request.  Motion carried.

Fornstrom submitted a request from 24 Real Estate, LLC for a Variance pursuant to Chapter VI of the Sublette County Zoning and Development Regulations.  This application proposes a Variance to the Minimum Site Area standards pursuant to Chapter III, Section 18, of the Sublette County Zoning and Development Regulations.  The property affected by the application lies with the (PT NWNE/4, Section 32, T31N, R106W.  Commissioner Bousman made a motion to approve the request. Commissioner Rawhouser seconded the motion.  Motion carried.

Fornstrom submitted a request from Christine Hae-Kyung Kwak, Trustee proposing a Minor Subdivision pursuant to Chapter XII, Subchapter V, of the Sublette County zoning and Development Regulations.  This application proposes the subdivision of Tract 16, of sheet 6, of the Hoback Ranches Subdivision.  The proposed Minor Subdivision of said 19.52 ac tract would create two lots 977 ac in size.  It was moved by Commissioner Bousman, seconded by Commissioner Rawhouser to table the request.  Motion carried.

Brian Gray, representing Jorgensen & Associates, updated the Board on the Hoback Ranches culvert grant project.  He stated the culverts have been inventoried and identified.  Gray stated his firm would have more to report at the next meeting. 

There being no further business, the meeting was adjourned at 2:10 P.M.

Department of Environmental Quality, Division of Air Quality PUBLIC NOTICE:  In accordance with Chapter 6, Section 2(m) of the Wyoming Air Quality Standards and Regulations, notice is hereby given that the State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Jonah Energy LLC (CMP100053) to modify the Stud Horse Butte 11-17 Central Facility (F015009), with the addition of production and equipment associated with three wells, the Gobblers Knob 17, 19 and 29, with one common smokeless combustion device to control volatile organic compound and hazardous air pollutant emissions associated with the dehydration unit, condensate tanks, active produced water tanks and pneumatic pumps, located in the NE1/4SW1/4 of Section 17, T29N, R108W, approximately eighteen (18) miles southwest of Big Sandy, in Sublette County, Wyoming.  Jonah Energy LLC has met the demonstration requirements under Chapter 6, Section 2(c)(ii) for this permitting action since current emissions are less than emissions during the baseline period.  VOC emissions have decreased 4.7 TPY from the baseline period and NOx emissions have decreased 1.8 TPY from the baseline period.  These reductions have been added to Jonah Energy LLC’s offset bank to use for future permitting actions.

Therefore, Jonah Energy has met the offset requirements for VOCs and NOx.
